Legal Notes and General Conditions of the Contract
1. Scope and object of the contract.
- These General Terms and Conditions govern the relationship between Casalmare Via Asse, Casalmare Corti (CAV) and Casalmare Sabina (AAUT) di Zanoni Erio (hereinafter referred to as Casalmare) and the Customer with regards to the provision of accommodation services chosen by the Customer in the booking proposal made from among those offered by the Facility, viewable on the website www.https://casalmareventimiglia.myweb.smoobu.com.
- The request for provision of the Services can be made by the Customer by submitting the Booking Proposal to Casalmare via:
- sending emails to the following email addresses: casalmaresabina@gmail.com, casalmareviasse@gmail.com, casalmarecorti@gmail.com;
- by telephone, verbally, by contacting the numbers 39 3931077329 and 39 3478251691;
- using the online booking procedure on the website.
- The contract is deemed concluded when the Customer submits the Booking Proposal as described in point 1.2 and brings it to Casalmare's attention. The actual conclusion of the contract is always subject to the availability of the Service. This confirmation is provided by Casalmare upon receipt of the Proposal or immediately after receipt of the final payment or deposit as agreed.
- If the activation of the Services cannot take place due to impediments not attributable to Casalmare, the contract will be automatically terminated, without this entailing any liability on the part of Casalmare towards the Customer.
2. Activation and provision of the Service.
- Upon activation of the Service, Casalmare guarantees the Customer:
- the enjoyment of entire housing units furnished and set up in consideration of the number of guests defined in the Proposal.
- the internet connection.
- weekly linen change, and all services provided for by current regional law regarding "Holiday Homes and Apartments" (CAV) and "Furnished Apartments for Tourist Use" (AAUT)
- Casalmare will provide the Customer with any other accessory equipment required for full use of the selected Services (keys, passwords, etc.) on loan for use.
- The Customer must use the accommodations and appliances in a manner that does not disturb the neighborhood. The Customer will be solely responsible for any direct damages resulting from the violation of this obligation, holding Casalmare harmless from any consequences, costs, or charges.
- The Customer will indemnify Casalmare from any prejudice, damage, liability, expenses, including legal expenses, suffered or incurred by Casalmare, and will also indemnify it from any action, reason, or claim brought against it by third parties that find their cause or motive in behavior and/or omissions in any way attributable to the Customer himself or are in any way a consequence of non-compliance and/or violation of the provisions set forth in these General Contract Conditions.
3. Booking and Payment.
- In the case of a reservation for a future date, Casalmare requires the Customer to pay the balance due 14 days before the first day of arrival and overnight stay, using the following payment methods:
- Bank transfer.
- Credit card.
- PayPal
- Cash on arrival only for balance payments of reservations with deposit paid using methods a), b), c)
- Failure to pay the amount due within the above terms will result in the cancellation of the reservation, without any need for communication from Casalmare.
- Tourist tax: €2 per person per night, payable in cash upon arrival, for a maximum of 7 consecutive nights. Children under 14 are exempt from payment.
4. Duration of the Contract, cancellations and penalties.
- The Contract is valid and effective from the date of conclusion of the Contract itself and ends if both of the following conditions are satisfied:
- the Client and third parties connected to him, or dependent on him, have definitively left the Casalmare residential facility;
- the Customer has paid the entire amount due to Casalmare.
- Check-in is between 4:00 PM and 8:00 PM. Early or late check-ins are by arrangement and subject to property availability. Failure to provide advance notice of your arrival time may result in lengthy waits, for which no complaints or refunds will be accepted.
- Check-out must be done by 11:00 am. Failure to do so will result in an additional night's stay being charged.
- The Customer has the right to cancel the reservation and terminate the contract within the timeframes set forth in point 3.1. No refund will be provided to guests who cancel less than 14 days before the start date of their stay or who leave Casalmare early, regardless of the reason.
- In the event of a failure to show up on the scheduled arrival date, unless otherwise communicated, which justifies delays, the contract will be considered terminated starting from the day following the arrival date.
- The length of stay cannot exceed 30 consecutive days. Any reservation exceeding this period will be cancelled without any further notice from Casalmare.
5 Responsibilities of Casalmare
- Casalmare will be responsible for any breach of contract and for the provision of the Service exclusively for reasons attributable to it.
- If upon arrival the Customer finds a Service different from the one agreed upon but accepts it anyway, he/she will automatically be deemed to have forfeited any right to compensation and the new Service will replace, by agreement of the parties, the one previously agreed upon.
6 Limits of Liability.
- Casalmare will not be responsible for delays, inconveniences, malfunctions and/or interruptions of the Service due to:
- fortuitous event or force majeure;
- tampering or interventions on the service or equipment carried out by the Customer or by third parties not authorised by Casalmare;
- damage or inconvenience caused by the total or partial interruption of the electricity or water supply;
- Casalmare will not be responsible for valuables owned by guests and brought into the facility.
7 The management recommends:
- Silence/Children. Total silence must be observed from 11:00 PM to 8:00 AM. Children must always be accompanied by an adult. In any case, behavior must be such that at no time and in no way does it disturb the tranquility of others.
- Other Guests. It is strictly forbidden to bring other people into the accommodation. The client may not sublet or loan the accommodation, in whole or in part, under penalty of immediate termination of the contract.
- Smoking/Weapons/Drugs. Bringing weapons, narcotics, and other substances into the apartment is strictly prohibited. Failure to do so will result in immediate termination of the contract. Smoking is also strictly prohibited inside the apartment. Smoking is permitted on the balconies, but please use the ashtrays provided.
- Animals. Bringing animals of any kind or size is strictly prohibited.
- Restrooms. We recommend proper and civil use of the restrooms, avoiding throwing anything in the toilet (use the designated bins).
